 Victory for Survivors: New Law Protects Survivors Who Report Sexual Offenses

Mississippi Governor Tate Reeves Signs RAINN-supported Bill Into Law

 

Jackson, M.S. – April 2025, Mississippi takes a powerful stand for survivors with the enactment of HB 861 and SB 2313, landmark legislation designed to protect those reporting sexual assault. These crucial laws provide limited immunity from prosecution for alcohol and drug misdemeanors to survivors and witnesses who come forward to report sexual offenses.

“Today, Mississippi stands with survivors,” said Mollie Montague, RAINN’s director of state legislative affairs. “The enactment of HB 861 and SB 2313 removes a critical barrier that has silenced too many voices. By empowering survivors to come forward, Mississippi is not only seeking justice for past crimes, but is also taking a vital step towards preventing future violence.”

 

Before this law, Mississippi survivors had cause to fear being sent to jail for reporting a drug-induced sexual assault. Nationwide, as high as 84 percent of sexual assaults involve the use of drugs or alcohol by the victim, and more than 2 out of 3 sexual assaults go unreported to police. Fear of legal consequences for drug and alcohol use has prevented victims from reporting sexual violence and inadvertently shielded perpetrators. This legislation directly addresses this injustice, empowering survivors to break the silence and seek help without fear of self-incrimination. By encouraging reporting, HB 861 and SB 2313 enable law enforcement to thoroughly investigate these violent crimes and hold offenders accountable.

Drawing inspiration from successful campus policies and similar legislation in states like Tennessee, this effort prioritizes the safety and well-being of survivors across Mississippi. This is a significant victory for all Mississippians who believe in justice, safety, and empowering those who have experienced sexual violence.
